The rules, in plain language

We have tried to write these so you can actually read them.

Draft. These terms reflect how the game works, but they have not yet been reviewed by a lawyer. They will be before the token launches.

Who these terms are with

“We” and “us” on this page means the team that runs bobibird.com. The legal entity that operates the game will be named here before the token launches, after legal review. By playing BobiBird you agree to these terms.

What BobiBird is

A game. You buy eggs, raise birds, and trade them. It is not an investment product, not a financial service, and not a promise of a return of any kind.

No guarantees about money

  • Tokens locked in a Bobi are returned in tokens, never in dollars.
  • The value of $BOBI can fall to nothing, and there may be times when you cannot sell it at any price.
  • Prizes are capped, funded by fees, and most players will never receive one.
  • Nothing here is investment advice.

The risks page sets out these and the other ways the game can cost you money.

Your account

  • You are responsible for your wallet. We cannot recover a lost key.
  • One account per person. Multiple accounts to gain an advantage in competitions or referrals is cheating.
  • You must be 18 or over.

Your country and your law

Whether you are allowed to play, or to buy or hold $BOBI, is decided by the law where you live, not by us. It is your job to know that law. Eggs are a paid random outcome and the game runs on a crypto token, and some countries restrict one or both.

We do not block any country, and there is no list of blocked countries. $BOBI trades on a permissionless bonding curve on Solana. We do not control that curve, and we cannot stop anyone from buying or selling the token. We do control the game itself — the website and your account — and access to that is something we can end. Once you hold $BOBI, we cannot take it back.

None of that is permission. We are not your gatekeeper, and that cuts both ways — nobody here is checking for you. Where the law does not allow it, do not do it.

We may refuse or end access to the game where we are required to, and to anyone under sanctions. If the law later requires us to restrict the game somewhere, we will restrict it. We are not promising that this will happen, and we are not promising that it will not.

Cheating

Any of the following can cost you your prizes, your account, or both:

  • Running many accounts to farm referral bonuses or competition entries.
  • Exploiting a bug instead of reporting it.
  • Automating in a way that misrepresents care you did not give.
  • Manipulating the token price to change what things cost in the game.

Find a real bug and tell us instead, and we may reward you for it. Whether there will be a formal bug bounty, and on what terms, will be set out here before the game opens. That is a far better outcome for you than being banned.

Your Bobis

Your Bobis are yours. Each one is meant to be a compressed NFT in your own wallet; the mint is built and waits on approval from the multisig that holds the collections, so no Bobi is on Solana yet and for now yours is a row we keep in your name. That does not change who owns it, and it does not change the rules below. Apart from a wallet change you ask for yourself, which moves every Bobi to your new wallet after the seven-day wait, there are three cases in which the game moves one out of your wallet, and by playing you agree to all three:

  • Neglect. A Bobi left unfed for seven days goes to the shelter. It is moved to the shelter wallet, half its locked tokens are burned, and another player can adopt it. For the first seven days you cannot adopt it back yourself.
  • Listing. A Bobi you list for sale is held in escrow while the listing is open. If it sells, it goes to the buyer. If the listing ends unsold or you cancel it, it comes back to you.
  • Cashing out. A Bobi you cash out is burned, and its locked tokens, less the exit fee, are paid to your balance.

How the game is able to do this: when your Bobi is minted, you are recorded on Solana as its owner and the game is recorded as its delegate. A delegate can move a Bobi but cannot own it, and cannot stop you moving it yourself. That is what will make the three cases above possible without us ever holding your Bobi. Until the mint runs there is no owner and no delegate on Solana to look up: a Bobi is a row in our database, and all three of those moves happen because our software makes them. The delegate will stay in place while the Bobi is in the game, so for as long as you play, the game can move it in those three cases and in no others. Once a Bobi is minted, both the owner and the delegate are visible on any Solana explorer, so from that point this is checkable rather than something you have to take our word for.

How you may use the artwork of your own Bobi, and whether that includes commercial use, will be set out here before the game opens, after legal review. Making a competing game out of it will not be allowed.

Tokens we hold for you

Two kinds of $BOBI sit in wallets we operate — not in your wallet, and not in a contract:

  • Your spendable balance: tokens you deposit, and whatever a cash-out or a sale pays you, until you withdraw them. Withdrawals have limits, including a cap on how much can leave in any 24 hours and a seven-day pause after you change the wallet on your account.
  • Locked tokens: the share of each purchase that is locked in a Bobi or in an accessory, held in a pool wallet and recorded against that Bobi or accessory in our ledger.

You are trusting us to hold these and to pay them out. We never hold your SOL, your USDC or your private keys.

Changes to the game

Live games get balanced. We may change prices, rules or scoring. We will announce changes before they take effect and explain why.

If we have to stop

If BobiBird closes we will say so plainly and in advance. Bobis in your wallet stay there. The tokens we hold for you — locked tokens and spendable balances — are in wallets we operate, not in a contract, so returning them is something we would do rather than something the chain does automatically.

Liability

The service is provided as it is. We are not liable for losses from token price movements, chain outages, wallet compromise, or your own missed feeding windows.

Governing law and disputes

If you think we have got something wrong, tell us first (see Contact, below). Most problems in a game turn out to be a bug or a misunderstanding, and we would rather put it right than argue about it.

The law that governs these terms, where a dispute would be heard, and the formal process for raising one have not been decided yet. They will be set out here before the token launches, after legal review.
